What does it take to create solid noncompete agreements?

If you keep up on the business scene in North Carolina, you probably spotted the news that some 225 employees in the state who work for Avery Dennison Corp. are being shown the door. It made headlines in the Charlotte Business Journal. The company is pulling the plug on production at two sites and moving the work to Mexico and Honduras.

After basic contracts, a shareholder agreement might be wise

There may be some who long for the days when a business could be run on a person's word and a handshake. Those days, if they really ever did exist, don't any longer. As we have noted in a number of posts, including one early last month, it is more important than ever to have agreements in writing. Is a wrongful death claim possible after a fatal work accident?

Anyone who has ever suffered a serious workplace accident likely is aware that medical care and rehabilitation gets paid for outside of usual channels. North Carolina, like all states, has a law on the books related to workers' compensation coverage. In our state, a business with three or more employees is required to have necessary insurance or be qualified to self-insure.

Money lent may amount to money spent without a promissory note

There was a time when a handshake was as good as a contract. In some cases, the deal might have involved the borrowing of a small amount of seed money to get a small business off the ground. In others, it might have been a local storeowner extending a line of credit to friends and neighbors.
