• $13 million - Medical Negligence verdict for an infant who was admitted to a North Carolina hospital for observation following multiple skull fractures from a home accident, but later suffered an undiagnosed case of bacterial meningitis that caused severe neurological damage.
• $10 Million - Car Accident Verdict - Verdict for a child who sustained a severe traumatic brain injury in an automobile accident. This is believed to be the largest car accident verdict ever in Mecklenburg County Superior Court. Both defendants were represented by experienced insurance defense counsel. At a court-ordered mediation settlement conference, State Farm Mutual Automobile Insurance had refused to make any settlement offer whatsoever to the injured child, denied obligation to pay any amount and then made a verbal promise to its insured that it would pay any verdict that was returned in the case.
After the verdict, State Farm filed an appeal on behalf of its insured but failed to post an appeal bond. A second lawsuit was then filed against State Farm to force the insurance company to pay the entire amount of the verdict. The case was settled shortly after the second case was filed for $11,248,111.
• $9.075 Million - Car Accident Verdict - Confidential settlement for a family struck by an underage impaired driver who had purchased alcohol at a convenience store shortly before the crash. The collision resulted in the death of an unborn child, severe brain injury to a 4-year-old child and internal and orthopedic injuries to the mother and other occupants in the car.
• $8 Million - Confidential Settlement - Confidential settlement for an infant with bilateral leg amputations following improper placement of the femoral line. The case was resolved in association with former US Senator John R. Edwards. - Mecklenburg County, North Carolina
• $2.9 million settlement on behalf of a 6-year-old girl killed by a drunk driver. The crash occurred in 2015 when a former UNC student drove the wrong way on Interstate 85 after consuming alcohol from private parties and Franklin Street bars. The settlement included more than 15 defendants charged with providing the underage defendant access to alcohol and marijuana. The crash claimed the lives of three people.
• $4.75 Million - Defective Automobile - Settlement for a woman severely injured as a result of a defective automobile. The case was resolved in association with local counsel in the state of Florida. - Brevard County, Florida
• $3.375 Million - Failure to Diagnose - Confidential settlement on behalf of a child with severe visual impairments resulting from the failure to properly diagnose retinopathy of prematurity in a newborn child. - South Carolina
• $3 Million - Cerebral Palsy - Confidential settlement for a child with cerebral palsy as a result of birth-related brain injury. - Gaston County, North Carolina
• $3 Million - Negligent Administration of Nerve Block - Confidential settlement for a woman with hypoxic-ischemic brain injury as a result of negligent administration of nerve block for headache. - Mecklenburg County, North Carolina
• $2.5 Million - Traumatic Brain Injury - Recovery for a woman who sustained a traumatic brain injury after her vehicle was struck by a commercial truck while stopped for traffic in a construction zone. A substantial reduction of the workers’ compensation lien was negotiated and the lien was resolved for a total payment of $100,000. The woman will continue to receive weekly workers’ compensation benefits and all future medical expenses will be paid by the workers compensation insurance carrier. - Alamance County, North Carolina
• $2.5 Million - Traumatic Brain Injury - Workers’ compensation settlement for a man who sustained a traumatic brain injury while employed by a logging company. - Guilford County, North Carolina
• $2.328 Million - Defective Bow-Flex Machine - Jury verdict on behalf of a man injured by defective Bow-Flex machine. The verdict included $2 million in punitive damages. - Obion County, Tennessee
• $2.3 Million - Wrongful Death - Settlement for estate of man killed in collision with a truck. The case was resolved in association with local counsel in the state of South Carolina. - York County, South Carolina
• $2.250 Million - Wrongful Death Settlement - Wrongful Death settlement for the family of an unarmed Charlotte man who was shot 10 times by a Charlotte-Mecklenburg police officer. The case received extensive coverage in both the national and local media.
The settlement amount paid was almost 3x higher than the City of Charlotte had ever paid in the past to resolve an excessive force case against CMPD. - Mecklenburg County, North Carolina.
• $2.1 Million - Hypoxic-Ischemic Brain Injury - Confidential settlement for woman with hypoxic-ischemic brain injury as a result of air embolism during cardiac bypass surgery. - Catawba County, North Carolina
• $1.84-plus Million - Pedestrian Accident - Recovery for a pedestrian who suffered a traumatic amputation of her leg when a bus crashed into a parked truck, causing the truck to jump the curb and strike the pedestrian as she was entering a restaurant. - Buncombe County, North Carolina
• $1.73 Million - Scaffolding Accident - Workers’ compensation settlement for undocumented worker paralyzed in a fall from a scaffold. - Mecklenburg County, North Carolina
• $1.637+ Million - Dram Shop Jury Verdict - Jury verdict for young married couple struck by a drunk driver who had just left a bar where he had been served more than 10 drinks in just over two hours. The jury verdict is believed to be the largest contested dram shop verdict in North Carolina. The highest pre-trial offer was $125,001. - Mecklenburg County, North Carolina
• $1,555,000 – Recovered for seriously injured Fayetteville woman who underwent multiple surgeries following crash with Cumberland County Schools yard work truck.
• $1.5 Million - Hypoxic Brain Injury - Recovery for a woman who sustained a hypoxic brain injury as a result of developing sepsis from a surgical error during laparoscopic gynecologic procedure. - Mecklenburg County, North Carolina
• $1.3 million settlement for the family of a Charlotte man killed by a drunk driver. The victim was transporting his elderly mother from Michigan when the crash occurred. She survived significant injuries, including bilateral ankle fractures. The drunk driver, whose blood alcohol concentration was .19, was traveling the wrong way on Interstate 77 near Statesville. Our attorneys conducted a thorough investigation of the drunk driver, including her phone and credit card records. • $1.3 million - Motor Vehicle Collision - Arbitration award for a man with mild traumatic brain injury as a result of a motor vehicle collision. There was no loss of consciousness at the time of the collision. - Mecklenburg County, North Carolina
• $1.3 million - Traumatic Brain Injury Verdict - Verdict for a woman with mild traumatic brain injury as a result of a motor vehicle collision. This is believed to be the largest mild traumatic brain injury verdict in the state of North Carolina at the time. - Mecklenburg County, North Carolina
• $1.36 million recovered for the family of child killed trying to board school bus. Read more.
• $1.1 million - Failure to Diagnose - Recovery for an infant where doctors failed to diagnose a serious bacterial infection that led to meningitis with serious neurological consequences.
• $1.05 Million - Traumatic Brain Injury - Arbitration award for a mild traumatic brain injury sustained in an automobile wreck. The highest offer from the insurance company was $75,000. - Cumberland County, North Carolina
• $1 million recovered for a child sexually abused at a day care center.
• $1 Million - Garbage Truck Collision - Settlement for a man with a mild traumatic brain injury after a collision with a garbage truck. The case was resolved in association with local counsel in the state of Connecticut. - New Haven, Connecticut
• $975,000 - Fatal Truck Accident - Recovery for the wrongful death of a truck driver killed in a collision on I-40. He was survived by his wife and by two children. - Catawba County, North Carolina
• $950,000 - Collision With a Tractor-Trailer - Settlement for a man with severe orthopedic injuries as a result of a collision with a tractor-trailer that was backing across the highway. - York County, South Carolina
• $800,000 - Collision With a Flatbed Trailer - Settlement for a woman with mild traumatic brain injury following a collision with a flatbed trailer that disconnected from construction company dump truck while on an interstate highway. - Mecklenburg County, North Carolina

• $625,000 - Forklift Accident - Recovery for a truck driver who was struck by a forklift at a warehouse facility while they were unloading his truck. - Forsyth County, North Carolina
• $600,000 - Construction Accident - Recovery arising out of a fall on a construction site where the general contractor failed to have OSHA-required barriers in place. $450,000 plus medical benefits were recovered under workers’ compensation. - Iredell County, North Carolina
• $599,500 settlement on behalf of the estate of a father of three. Our client, an electrician, was working in a manufacturing facility when he was knocked from an elevated scissor lift. We found that the facility's owners forced their employee to operate the crane with blind spots.
• $500,000 - Workers’ Compensation Settlement - Workers’ compensation settlement for a man who contracted a rare neurologic disorder after exposure to industrial and residential sewage. - Mecklenburg County, North Carolina
• $451,000 – Multiple car – semi-truck collision in Bladen Co. The female victim, our client, sustained extensive injuries, including broken bones, fractures, punctured lungs and lacerations.
• $375,000 – Two motorcyclists hit an oncoming car resulting in them sustaining fractures, abrasions and contusions.
• $350,000 – Motor vehicle crash in Harnett County resulting in a concussion, retrograde amnesia, spinal, foot and leg fractures in addition to multiple lacerations, abrasions and bruises (Maximum compensation under policy limits)
• $300,000 – Limits of homeowners insurance coverage recovered for Hoke County child who suffered facial wounds as a result of a pit bull attack.
• $300,000 – Motor vehicle accident in Sampson Co., resulting in right-hand contracture and lumbrical impingement requiring surgical repair, and eventually resulted in Complex Regional Pain Syndrome (Maximum compensation obtained under policy limits)
• $300,000 – Motorcycle accident in Cumberland Co. resulting in head, face, arm and legal injuries (Maximum compensation under policy limits)
• $275,000 – Dog attack resulting in multiple injuries that required immediate medical attention
• $250,000 settlement for a motorists who sustained serious injuries in a motor vehicle collision.
• $250,000 pre-suit settlement for a Wake County boy attacked by his best friend's dog. The victim sustained two facial lacerations that resulted in permanent scars.
• $250,000 recovered for a Durham County man struck head-on by a drunk driver. Attorneys Shawn Howard and Karl Gwaltney recovered the maximum available insurance from both bodily-injury coverage and property damage coverage. The drunk driver had a previous record of driving under the influence.
• $250,000 – Young adult suffered from a massive blow-out central disk herniation with severe canal stenosis and neurogenic claudication following a motor vehicle accident (Maximum compensation obtained under policy limits)
• $205,000 – Motor vehicle crash in Columbus Co. involving ankle injury (Maximum compensation obtained under policy limits)
• $200,000 recovered on behalf of two men killed in an Alamance County automobile crash.
• $200,000 tender of all available insurance on behalf of a Wake County passenger killed in a single vehicle drunk driving crash. Attorney Shawn Howard obtained the under insured motorist (UIM) policy limits.
• $200,000 settlement for a motorcyclist whose vehicle seized up during operation after it was left for repairs at a mechanic. Attorney Shawn Howard hired a forensic reconstruction engineer who determined the repair shop failed to adequately torque a bolt on the caliper.
• $200,000 recovered for a Raleigh boy attacked by a pit bull. The dog had already bitten one other person in the community. In addition, it was the third incident to which the Raleigh Animal Control Department responded. The insurer's original offer was only $30,000.
• $200,000 – For Fort Bragg paratrooper who suffered neck injury in car accident.
• $200,000 – Limits of insurance coverage obtained for Bladen County 14 year old who suffered perforated bowel following motor vehicle crash.
• $200,000 – Limits of insurance coverage obtained for Fayetteville motorcycle accident client who suffered traumatic brain injury.
• $200,000 – Settlement for Fayetteville man who suffered broken a toe and broken wrist in bicycle accident.
• $150,000 limit of insurance for Chatham County man who sustained brain and shoulder injuries in automobile collision.
• $150,000 settlement for the father of a young man killed in a drunk driving accident. The driver crossed the center line of the road and into a ditch. Many other firms rejected this case because our client's son voluntarily rode in a vehicle with an intoxicated driver. Attorneys Ed Maginnis and Shawn Howard successfully argued it was possible that the driver had not shown any signs of intoxication and therefore the passenger was not at fault.
• $150,000 – Obtained for Fayetteville man hit by drunk driver on Skibo Road who suffered traumatic brain injury.
• $150,000 – Motor vehicle crash in Wake Co., resulting in L5 pars defect, and L5 on S1 Grade 1 Anterolisthesis/Spondylolisthesis requiring L5-S1 Laminectomy with Interbody Fusion (Maximum compensation obtained under policy limits)
• $150,000 – Confidential settlement for 5th grader injured at school in Robeson County
• $147,000 recovered for a Chatham County boy who suffered a wrist fracture in a motor vehicle collision.
• $137,000 settlement for a Randolph County injured as a passenger in a car that was T-boned in an intersection. The defendant ran a red light and our client required neck surgery. Despite the insurance company claiming the injury was pre-existing, attorney Shawn Howard successfully argued the crash significantly aggravated previous issues.
• $135,000 – Motor vehicle crash on Fort Bragg injuring an active-duty soldier
• $131,000 – The above case also involved injury to a child that required surgical repair.
• $130,000 – Litigation settlement for Fayetteville client who sustained serious injuries as a pedestrian walking to the gym.
• $110,000 recovered for a firefighter injured at a training site. The trainee was pulling a hose over a railing when the railing broke and he fell to the ground.
• $110,000 litigation settlement for a 3-year-old boy attacked by a neighbor's pit bull. The insurance company's original offer was only $30,000.
• $106,850 – Motorcycle accident in Cumberland Co. resulted in metatarsal fractures and a dislocated shoulder.
• $100,000 – Limits of insurance obtained for Southern Pines woman who underwent arm surgery after automobile collision.

• $83,000 – Recovered for Smithfield Foods employee injured going to work by tractor-trailer accident.

• $2 million jury verdict for fraud/trade secret business litigation.
• $250,000 settlement for a Greenville man ousted from a small business he helped start.
• $113,563 trial verdict for a breach of non-compete contract interference and unfair and deceptive trade practices act. The award was more than eight times the best settlement offered by the defendants made.
• $96,961 judgement against a real estate developer on behalf of a Raleigh architect who was not paid for work on a residential complex.
• $75,000 obtained by attorney Garrett L. Davis for a small business for lost profits in a breach of contract case.
• $70,000 settlement for a North Carolina businessman who had been misled regarding the assets and value of a store he purchased.
• Lawsuit dismissed against Raleigh plumbing contractor sued for $282,000 relating to unpaid materials purchased in a credit account. Attorney Ed Maginnis filed and litigated a counterclaim alleging improper pricing methods by the supplier, and the matter settled for a mutual dismissal.
