Accident in North Carolina could lead to wrongful death case

Most people understand that there is a chance of being involved in a car accident when they travel. Additionally, people are aware that an accident can lead to serious injury or even death. People do not know, however, how tragedy chooses one family, but skips another. In one incident in North Carolina, the family members of two car accident victims may choose to file a wrongful death case against the driver of the car who was able to survive.

In the early hours of a late December morning, three passengers were traveling in a sports car in North Carolina. Police reports indicate that the driver struck a curb. As a result, he overcorrected, which caused the car to exit the road and strike a tree.

The two passengers, a 38-year-old and a 27-year-old, died as a result of the injuries they sustained in the accident. The driver was transported to a local hospital, but his injuries are not considered life-threatening. Police have not filed criminal charges at this time but continue to investigate the accident.

Sometimes, there simply is no answer as to why an accident claimed one life while sparing another, but it is clear that the families of the deceased will have to cope with both the emotional and financial ramifications of their loved one's death. In order to seek help with the financial burdens created by the accident, including funeral expenses and the loss of wages, the victims' families have the option of filing a wrongful death case in a North Carolina Civil court against the driver. If they can prove the accident was caused by the negligence of the driver, the court could order a monetary award to help with the costs and other financial losses created by the accident.
